Conveyancers are not tax lawyers, yet if we produce the conveyancing documents we are “tax agents” according to the legislation, even if somebody else advises on SDLT; we cannot contract out of our statutory liability. Law and practice continue to change.
Land Transaction Tax will replace SDLT in Wales from 1 April 2018. The Budget on 22 November introduced first time buyers relief, and changed the surcharge rules. HMRC is taking a hard, and arguably wrong, line on mixed-use claims. Its guidance on the web, and from the Helpline, is unreliable.
In this three-hour session we will be reminded of the rules, then look in greater detail at current issues, including:
- first-time buyer relief - not as generous as publicised
- the surcharge rules, including the changes
- more surcharge anomalies - and the upcoming impact of the 3-year rule
- problems with mixed-use
- the debt rules unpacked
- what is a single transaction?

He now provides SDLT training and consultancy. He is responsible for many standard forms, including the RICS common auction conditions.
